Brazil regulated betting market exists. It is not a project, not a promise, and not a legislative aspiration. The federal framework is in force, licensed merchant are active under it, and the Secretaria de Prêmios e Apostas (SPA) has moved well beyond issuing licences — it is now identifying and disrupting activity that falls outside the regulated system. Anyone still treating Brazil as a market “about to open” is working from an outdated map.
That said, the boundaries of what sits inside the regulated system are genuinely contested, and that contest has direct commercial consequences.
Several bills currently before the Brazilian Congress address substantive questions: whether fixed-odds betting should remain available for virtual events, whether certain forms of digital gambling should be prohibited outright, and whether prediction markets warrant their own statutory framework. None of these proposals are law today. Taken together, however, they force a question that international gaming businesses cannot defer: what exactly will sit inside — and outside — Brazil regulated perimeter in the years ahead, and what follows legally from that answer?
The stakes extend well beyond licensing. Product design, market access, payment processing, banking relationships and the viability of offshore structures serving Brazilian customers are all affected by how that question is ultimately resolved.
Brazil Already Has a Regulated Market
The starting point matters, because it is frequently misunderstood.
Brazil established a federal regulatory framework for fixed-odds betting under Law No. 14.790/2023 and subsequent implementing regulations, administered by the SPA within the Ministry of Finance. The framework covers licensing and authorisation, corporate structure, player identification, responsible gaming, anti-money laundering controls, advertising, technical standards and payments. The precise scope of each requirement depends on the applicable legislation and implementing rules in force at any given time — always confirm the current text on the SPA’s official legislation page before relying on it.
The regulated market and the legislative debate now taking place are not the same thing. Brazil is not deciding whether to regulate online betting. It is debating where the boundaries of an existing framework should be drawn — and that distinction is fundamental to how merchants, investors and payment providers should interpret current developments.
The Regulatory Perimeter Is Being Contested
Bill PL 3428/2026, introduced on 1 July 2026, proposes to amend Law No. 14.790/2023 to restrict fixed-odds betting to bets on real sporting events and prohibit exploitation of bets based on random virtual events. As of 17 September 2026, the proposal remains pending before the Chamber of Deputies. These are materially different outcomes, and conflating them at this stage is an analytical error with real operational consequences.
Outside a Licence Does Not Mean Unregulated
This is where international merchants most frequently make their most consequential mistakes.
The instinct — understandable, given how licensing works in mature markets — is to ask whether a particular product requires the Brazilian betting licence. If the answer is no, the assumption tends to follow that the product can be offered without one. That conclusion is not legally sound.
Being outside a specific licensing regime can mean several different things: the activity may be lawful without authorisation; it may fall within a different regulatory regime; its classification may be genuinely uncertain; or it may be prohibited. Each outcome carries different legal consequences, and none of them can be resolved simply by pointing to the absence of a licensing requirement.
The correct question is not whether a product requires the Brazilian betting licence. The correct question is how Brazilian law classifies that particular product and what legal consequences follow from that classification. For merchants working with novel products — prediction markets, skill games, event contracts — this is not an abstract distinction. It determines whether a business model is viable at all.
Prediction Markets: Classification Before Jurisdiction

Calling something a “prediction market” or an “event contract” does not, by itself, determine its regulatory treatment. What users actually do, and how the platform earns revenue, is what drives classification.
Simultaneously, PL 2651/2026 reportedly proposes the creation of a specific Brazilian framework for prediction markets, covering digital platforms, consumer protection and market integrity. That proposal is still moving through Congress; verify its current text via the Chamber bill-tracking system. Prediction-market activity therefore sits in a position requiring particularly careful analysis: subject to existing law and any applicable SPA guidance, while legislators simultaneously consider whether a dedicated statutory framework should eventually govern the space.

Skill Games: Commercial Label Is Not Legal Analysis
Skill-based gaming presents a different but structurally similar challenge.
“Skill game” is a commercially useful expression and a legally insufficient one. Products described under that label can have substantially different mechanics, and those mechanics are what regulatory analysis engages with. The degree of player skill involved, the residual role of chance, the prize structure, entry fees, the liquidity model, the relationship between participants and the platform, and the mechanism by which the operator generates revenue may all affect how a product is classified under Brazilian law.
Broad statements that “skill games are legal” or “skill games require a gaming licence” are unreliable without a prior examination of the actual product. The analysis that matters is product-specific: does the game fall within the existing definition of fixed-odds betting or online gaming; does another Brazilian legal category apply; does chance remain sufficiently material to affect classification; does the platform assume risk or merely facilitate competition between participants; who holds player funds at each stage. These questions carry more legal weight than whatever commercial label the operator has chosen.
Enforcement Is Catching Up With the Debate
The legislative discussion is only one dimension of what is changing in Brazil.
In September 2026, the SPA reportedly published Portaria SPA/MF No. 2.750/2026, expanding procedures intended to prevent, identify and repress payment transactions associated with the irregular exploitation of fixed-odds betting. According to Ministry of Finance communications, the framework includes mechanisms for identifying payment flows connected to irregular merchants, detecting the methods used to receive funds, interrupting financial flows linked to illegal activity, and blocking accounts or preventing new transactions. These descriptions are based on official announcements and should not be treated as a substitute for the operative text of the Portaria itself.
What makes this significant is less the specific measure than what it signals about where enforcement is headed. Cross-border gaming enforcement has historically focused on the operator — the website, the domain, the licence. Brazil is increasingly focusing on the financial infrastructure behind the operation. Changing a domain is operationally trivial. Replacing access to local payment rails, acquiring relationships and banking counterparts is not.
In July 2026, Brazil Federal Police reportedly announced an investigation involving 87 companies suspected of acting as intermediaries in the movement of funds connected to illegal betting operations, with indications that potential transfers involving crypto-assets were also under scrutiny. An investigation is not a finding of liability, and nothing here should be read as establishing that any investigated entity has committed an offence. What it does indicate is that financial flows have become a primary lens through which Brazilian authorities are examining unauthorised gaming activity.
For international merchants, this shifts the practical risk calculation. Where the operator is licensed is no longer the only relevant question. What is being offered in Brazil, to whom, and through which financial infrastructure matters just as much.
Offshore Licences: What They Answer and What They Do Not
Offshore gaming jurisdictions remain a legitimate and important component of the international gaming industry. Depending on the business model and intended markets, an offshore licence provides a regulatory base from which an operator conducts international activity, subject to the scope and conditions of that licence.
The error — and it is a common one — is to treat an offshore licence as answering more than one question. A licence answers where and under what regulatory framework an operator is authorised. Market-access rules answer where and under what conditions that operator may offer its services to customers. These are different questions with different answers, and the first does not determine the second.
This applies regardless of the jurisdiction in which the licence is issued. The legal effect and market-access implications of each licence must be assessed separately and verified against the law of each target jurisdiction. For Brazil specifically, the analysis must begin with the Brazilian classification of the product and the manner in which the Brazilian market is being accessed — not with the operator’s licence.
Passive Solicitation: A Legal Question, Not a Commercial Label
International businesses sometimes rely on passive solicitation or reverse solicitation frameworks when customers access a foreign platform without direct local marketing. These concepts have genuine legal relevance in certain regulatory contexts. They do not function as general exemptions from local gaming law.
Whether a particular operating model can legitimately rely on a passive or unsolicited customer relationship depends on the applicable Brazilian rules and, critically, on how the business actually operates. Marketing activities, affiliate arrangements, Portuguese-language content, local payment methods, local customer support, targeted promotions and local commercial partnerships are all potentially relevant to whether an operator is genuinely passive in relation to the Brazilian market. Passive solicitation is a legal and factual analysis — not a label that dissolves market-access risk when applied to a business model.
Licensing Strategy and Payment Strategy Are the Same Problem
The September payment measures reinforce something that gaming businesses sometimes learn at significant cost: licensing strategy and payment strategy cannot be designed in isolation.
An operator may identify a jurisdiction capable of licensing its product and still find that banks, payment institutions, acquirers and local payment providers will not support the model in its intended markets. Conversely, the fact that a payment method is technically accessible does not establish that the underlying gaming activity is legally permitted.
A sustainable cross-border structure requires multiple layers to function coherently: the licence, the corporate structure, the target-market analysis, the product classification, KYC and AML compliance, banking relationships, payment processing, technology infrastructure, and the actual flow of player funds from deposit through to withdrawal. If any of these layers creates a contradiction, the existence of a licence elsewhere does not resolve it.
What This Means in Practice
Brazil should not be characterised as a market that is simply opening or closing. That framing is too simple to be useful.
A functioning federal betting regime exists and is being actively enforced. Enforcement against unauthorised operators is becoming more sophisticated and is increasingly directed at financial infrastructure rather than digital presence alone. Congress is simultaneously considering proposals that could materially alter the product perimeter — shifting what sits inside and outside the licensed framework. And regulators continue to develop interpretive positions on products that do not fit comfortably within traditional categories.
The SPA’s own 2026–2027 regulatory agenda (published as Portaria SPA/MF No. 408/2026) confirms that several elements of the framework remain under active development, including operator authorisation procedures and rules concerning payments involving unauthorised operators. It is a planning document, not a source of legal obligations — unless and until specific elements are implemented through applicable legislation or regulation.
For international gaming businesses, this means Brazil cannot be reduced to a licensing question. The more productive sequence is: what exactly is the product; how is it legally classified under Brazilian law; which customers will it serve; what constitutes lawful market access for those customers; how will player funds move; which entities will hold those funds; and which banks and payment providers will support the structure. Only once those questions have substantive answers does the question of licensing jurisdiction become meaningful.
A Structure That Works Beyond the Licence
